Under New York Penal Law Section 125.12, Vehicular Manslaughter in the Second Degree, you may be found guilty of this offense if you drive a motor vehicle while intoxicated (BAC .08 or higher) or while under the influence of drugs and that as a result of your actions you caused the death of another person.
