Manslaughter in the First Degree
Under New York Penal Law 125.20(1) Manslaughter in the First Degree is charged whenever the circumstances and evidence warrant that one person has intended to cause serious physical injury to another person, and that injury then resulted in death. The New York Penal Code specifies this crime as a Class B Violent Felony with a maximum sentence of 25 years in prison if found guilty, and a mandatory minimum of five years in prison.
